1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the website at keshrmedia.com and the services provided by KESHR MEDIA LTD ("we", "us" or "our"). By using our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Definitions

"Client" means any individual or business that engages us to provide services. "Deliverables" means the final design, development or marketing materials produced for the Client. "Project" means the scope of work agreed between us and the Client.

3. Services

KESHR MEDIA LTD provides digital services including, but not limited to, website design and development, branding, marketing materials and managed hosting. The precise services, deliverables, timelines and fees for each project are set out in the applicable quote or proposal.

4. Quotes and acceptance

All quotes are personalised and provided in writing. A quote is valid for the period stated in it. A project begins only when the Client accepts the quote in writing (which may include email) and any required deposit has been paid. Until that point, no work is guaranteed to commence.

5. Client obligations

The Client agrees to:

• Provide accurate and complete information, content, assets and feedback in a timely manner.
• Ensure they have the right to use all materials supplied to us, including text, images, logos and trademarks.
• Review deliverables promptly and communicate approvals or requested changes clearly.
• Pay all fees in accordance with the agreed payment schedule.

6. Intellectual property

Upon full payment, the Client owns the final Deliverables created specifically for the Project. We retain the right to display the completed work in our portfolio, on our website and in marketing materials unless the Client expressly requests otherwise in writing prior to project commencement. Pre-existing materials, third-party assets and our underlying design tools or frameworks remain our property or that of the relevant third-party licensors.

7. Payment

Payments are processed securely through Stripe. Unless otherwise agreed, project fees are payable as set out in the quote. Hosting fees are billed monthly or yearly in advance, depending on the plan selected. All fees are non-refundable except where required by law or at our sole discretion.

8. Hosting

Managed hosting subscriptions continue until cancelled by the Client. We will use reasonable endeavours to maintain uptime, perform updates and keep the hosted site secure. Hosting does not include unlimited redesigns, content updates or recovery from issues caused by third-party modifications.

9. Revisions and project changes

The number of design revisions and the scope of included changes are set out in the quote. Additional revisions or changes outside the agreed scope may be charged at our standard hourly rate or quoted separately.

10. Cancellation and refunds

Either party may cancel a project by giving written notice. If work has already commenced, fees for work completed up to the cancellation date remain payable. Deposits are generally non-refundable once work has started. Hosting subscriptions may be cancelled at any time; no refunds will be given for the current billing period unless required by law.

11. Limitation of liability

To the fullest extent permitted by law, KESHR MEDIA LTD shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill arising out of or in connection with these Terms or the use of our services. Our total liability for any claim arising out of or relating to a Project shall not exceed the total amount paid by the Client for that Project.

12. Warranties and indemnity

We warrant that the Deliverables will be produced with reasonable skill and care. We do not warrant that the website will be error-free, uninterrupted or compatible with every device or browser. The Client indemnifies us against any claim arising from materials or instructions supplied by the Client that infringe the rights of a third party.

13. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to these terms

We may revise these Terms at any time by updating this page. The revised Terms will take effect when they are posted. Continued use of the website or our services after changes constitutes acceptance of the revised Terms.
